A very surprising thing happened in our company today. Shocking it may seem, they laid off 5 employees in my department today without any notice. Today's happenings makes me want to gather as much info as possible in case something unexpected might happen.
I am a July 2nd filer of 140/485 concurrently. No I140 approval yet. Received AP and EAD for both me and my wife.
If I request my employer not to revoke I140, will I be able to use my EAD for my next job?
Can someone give suggestions on what other options I have if something terrible happens to me?

IV is more than a website. We are trying to build a grassroots organization. Things are taking place offline as well.
It takes time to build the base. Strengthening the state chapters is one of the best thing we can do. Our first chapter meeting was very small as well but we will build from there. More members are forthcoming to meet lawmakers now.

Hi,
Employee of company A accepts an offer from another company B which promptly applies for a H1B transfer premium processing and its approved. Now the employee cannot join company B due to some problem and wants to remain with company A. Does company A need to apply for H1 transfer?
As I understand there will be no need to apply for the transfer again and the employee can continue working for company A. But the tricky part here is what if company B cancels the employees H1 visa seeing the employee did not join its workforce (considering that it just transferred it)?
Can some knowledgeable people please comment on the above scenario please.

Folks, don't make travel plans based on the approval e-mail that will be sent of automatically from USCIS. Mine & my wife's application's were approved and mailed nine days ago (6/18) and we made travel plans for yesterday (6/26) . Guess what. I got my approval notice in mail only yesterday and my wife's approval doc never came. We have to cancel the whole trip now.
Also, USCIS updated the status on our AP's four days later after the approval e-mail was sent saying the documents were mailed only on 6/22. Called the USCIS customer service three times and I got three different answers.
1. We sent approval notice on 6/18 and will be sending the AP document soon (In fact there is no such thing called approval notice and AP separately. This guy has no idea what he is talking about at the USCIS)
2. We sent the approval notice on 6/18 and confirmed that the document is out in the mail where in fact the document I received yesterday had a USPS stamping day of 6/22.
3. We sent the document on 6/22 and you should be gettting them in less than 30 days. If not please give us a call back.
Lesson learned. Don't trust USCIS and USPS delivery system and don't make travel plans unless you have all the doc's in hand.

Hi All,
I got a notice from uscis on sept 24th stating that my 485 has been withdrawn as my previous employer withdrew my 140. I filed in july 2007 , and ported to a new job in April 2008. I filed an MTR on 24th Sept, but the status of the MTR is still received and pending. Its going to be 180 days since my 485 has been withdrawn on march 9th. And my lawyer is saying that i have to leave this country if we dont get the MTR accepted before 180 days.
Gurus could you please suggest some ideas on all possible steps that can be taken..

As per my knowledge, your lawyer waited too long and he/she may not be very well versed in immigration matters. When MTR is pending and If you do not receive anything within 60 to 90 days, you should immediately file an appeal in court. This is what I read on some forums, but I am not a lawyer, consult a good attorney soon. You need a seasoned professional immigration lawyer for this. Wish you very best of luck!

bigboy.. We need about 20 volunteers per state to pledge 200 letters each. It is achievable. But 20 volunteers is far from reality. That is our challenge.
Friends Please dont jump on me as i make these comments. I am doing my best to convince ppl as i see across to Join IV and contribute to our efforts. But i also think that every state chapter should allocate some members who only concentrate on grass root efforts but nothing else to track how many memberships and etc and those should co-ordinate with every state to see how much they can target and how much did they reach. I know this might have been thought by some others but just what i am thinking ?

This thread was dead in October last year. This guy MartianSoldier restarted it ( and notice he has only 1 post ) for just one reason - start infighting among indians from different states.
Anyone falling into his trap and fighting on the thread ?
Martiansoldier really belongs not on Mars but in a mental asylum. Please don't post on this thread unless it has really got something to do with PIO card or the Indian consulate.

The constitution of India does not state that every citizen of India must know Hindi nor does it state that no matter where in the world an Indian lives, he must know Hindi to be an Indian citizen.
At the end of the day, no matter what anyone says or thinks of me, I still don't have one good reason to learn Hindi! Yet, I am a Proud Citizen of Indian and there is nothing that people like hpandey or ameryki can do about it! This is the truth and so will it remain!

I've been on the website for sometime, started out with a positive attitude, contributed etc, but got totally * turned off* by childish posts like the one from Logiclife. Emotional responses to situations is hardly the way to lead, especially a volunteer organization like IV. Do you think big exhortations and 'quotations' from all over the web motivate people??
Needhelp, you are doing a great job. It is insincere of people to not show up after they've committed, but what's new? We've all had that happen when we try to arrange large parties where the 'not so close' crowd is expected.
My 2 cents, instead of using impersonal bulletin boards and emails, lets try this:
- you * call * 2 of your friends and ask them to commit
- ur friends each calls 2 more friends and asks them to commit
I'm willing to bet, we'll get a better turnover this way.

Dear FOIA officer,
Several Employment based categories have been retrogressed for 4 years now and the exact number of pending AOS applications sorted by priority dates in the employment-based category is unknown. Department of state has been establishing the cut off in priority dates based on educated guesses and approximations. DOS and none of the Employment based applicants know the number of applications pending per category, per country sorted by priority dates. DOS visa office expressed similar concern in Oct 08 bulletin.
“Little if any forward movement of the cut-off dates in most Employment categories is likely until the extent of the CIS backlog of old priority dates can be determined.”
This information would be helpful in determining the priority dates accurately and in determining when a visa number will be available for a given priority date in a certain category. I request you to provide me with the number of pending employment based AOS applications, (excluding approved/denied) in the following categories sorted on a priority date basis from 2001.
EB-2 China & India: Number of employment based AOS applications pending with USCIS sorted by priority date on a yearly basis from year 2001 till now
EB-3 China, India, Mexico & Philippines & Rest of the World: Number of employment based AOS applications pending with USCIS sorted by priority date on a yearly basis from year 2001 till now

We received your request for information relating to Adjustment of Status applications in the employment-based category. You have specifically requested the number of pending employment based AOS applications, (excluding approved, denied) filed with USCIS since 2001, for each of the following countries and categories:
- EB-2 China
- EB-2 India
- EB-3 China
- EB-3 India
- EB-3 Mexico
- EB-3 Philippines
- EB-3 Rest of the World
Your request is being handled under the provisions of the Freedom of Information Act (5 U.S.C 552). It has been assigned the following control number: NRC2008065126. Please cite th is number in any further inquiry about this request.
In order to extract the information you have requested, a customized computer program will be required. You will be charged for the time it takes to write the program as well as the time involved in running the query to extract the date. You will not be charged for duplication, review and search time. We estimate the cost to be $5000.00. Due to the time and effort involved, you will be asked to sign an advance fee agreement before we proceed with your request. In addition, a deposit of $2500.00 payable by check or money order, must be paid within 30 days of the date of this notification. Please make your check payable to the United States Treasury, Failure to submit the $2500.00 deposit within the time frame given will result in your request being administratively closed.
