Hello friends
I am thinking of taking these semester off because of my health issue
I had decided to attend classes and booked my ticket in April to my country. I am an international student
So I was thinking how many months I can stay in USA after I take a semester break
Also if I take these spring break off and than the summer break is off by default so will it be a problem if I am not in status for 7 months?
Please let me know

Hi All,
USCIS has mailed my wife two different EADs upon renewal. The first EAD sent to us has a 2yr validity. About a couple of weeks later, she got another one, this time with a 1yr validity.
I spoke with my attorneys and they seem to indicate that the one with the 2yr validity should be the valid document of reference from here on.
My questions are,
1) have any of you experienced this kind of a goof up before?
2) do I just take my lawyer's word for it and ignore one of them?
Please advise...

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.

Hi,
My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?
Nope...she has to start with Labor and apply for a 140 in either EB3 or EB2 categories. Only L-1A visa holders are eligible to skip labor and apply in the EB1 category.

Dear IV members
This is for my wife. Her 485 is pending with TSC. PD is EB2 India March 15 2004. Has been current since September 1. After the USCIS website update recently received Document production or Oath Ceremony status update online. And message saying a document has been sent etc.
Since she was current we thought it might be good. 30 days later nothing received. Raised SR since we didnt receive anything. The customer service rep as usual didnt know anything. Said they haldn't received anything back. They opened SR. We got response 3 weeks later.
In the response letter it says that another notice will be forthcoming to tell you to go to local ASC.
Havent received anything. Do you think right now should I again pursue after them by writing to Ombudsman etc especially since case is current? Mainly I am afraid that since the status says Document production would some IO think that the case is already approved and so stop working on that case? Please advice. Thanks in advance.

I can't help but notice that about 1/4 of recently processed audit cases were denied. As it goes now, I'll have to wait about another 6 month for a 75% chance to pass. Well for where the economy is headed right now it all probably won't matter anymore in 6 months.
