    I absolutely do not agree that it will do more harm - given the current situation where every country is backlogged in EB3, and EB2 for India/China is also severely backlogged, there is very little chance that India and China can have more than 10000 visas (7% of 140,000) issued in Fy 2006 across all of Eb1/2/3.

    Current System
    EB1 China/India might benefit a bit because they will be the first ones to get the visas from extra EB1 visas but then, if Specter/Frist's bill passes, many of these EB1's will get a chance to file for 485 anyway.

    EB2 China/India might also benefit a little bit provided rest of the world leaves something behind.

    EB3 will not benefit at all as every country is backlogged here.

    Looking at FY 2005 statistics is very misleading. So, the way things are, any bill is better than no bill at all - at least we have a shot at improving the status quo we are in.

    Instead of just comparing current situation with future, especially when the future is so unclear, we should try our level best to achieve the following

    1. Put the clause back
    2. Amendment to file 485 after 140 or labor has been approved for certain time but Visa number is not available. Emphasis should be on the total wait time for GC, so that people in BECs do not get screwed.

    Put all your energy and efforts in achieving these and we will not see retrogression for many years. My goal is not to dissuade people from the comparison - it is a healthy exercise, but now that we know what the pros and cons are, let us work together to solve.

    If approached in the right way there is a chance that big law firms will be helpful to us. The way to do this is politely, not raising a stink, with a credible number of their clients supporting us. The big law firms could act as a "force multiplier" to use a military term, only a small fraction of the community currently know about us, the big law firms and USCIS are the common connection for EB GC process, and USCIS is not about to email all their customers about us. With the right encouragement law firms might just help.

    If they have members reading forums great. However, please do be civil.
    I do understand the need to vent and rant sometimes. My personal guide is not to post anything that I do not want to be publicly (or legally) held to. Also a balanced constructive post is useful for all. So I place my full name in my signature.


    Now when explained like this anyone would understand. Also do see the point you are making and is worth a try. Is the core team looking into this? Do they need any assitance from us?

    WASHINGTON � Carlsbad Rep. Brian Bilbray and other �anti-amnesty� House Republicans delivered a sharp warning Tuesday that compromise immigration legislation pending in the Senate faces raucous and determined opposition if it reaches the House.

    �The way you stop illegal immigration is not to start by announcing that you're going to reward illegal immigration,� said Bilbray, chairman of the 107-member Immigration Reform Caucus.

    The group, made up of 100 Republicans and seven Democrats, opposes the Senate and Bush administration proposal to legalize the nation's 12 million illegal immigrants as part of a broad package of immigration reforms.

    The Senate recently debated and shelved the proposal but is moving toward a second round of debate. If the Senate passes it, attention then will shift to the House.

    Last year, with Republicans controlling both sides of Capitol Hill, the House passed an enforcement-only bill while the Senate approved a sweeping legalization. With the two chambers moving in opposite directions, both bills died.

    This year, Democrats control both the House and Senate. For that reason, it is unclear whether Bilbray and his largely Republican caucus would be able to defeat the legalization legislation again this year.

    However, that didn't stop them from talking tough Tuesday in rejecting the latest gambit by proponents in the Senate to win over balky Republicans � a promise to spend $4.4 billion on border enforcement.

    �Only in Washington would people believe that throwing money at the problem is going to solve it,� said Bilbray. �This is a blatant attempt by senators to extort votes so they can fast track an amnesty plan.�

    �It's time to be resolute; it's time to show some backbone, and it's time to stop amnesty,� said Peter King, R-N.Y., who added that he would soon introduce enforcement-only legislation that would require a crackdown both at the border and at the workplace.

    Bilbray claimed that public outrage against the Senate bill has stunned many Democrats, making them wary of supporting the Senate approach.

    The Senate could take up the immigration bill late this week, beginning votes on a series of amendments expected to be presented by Republicans and Democrats. A final vote on the measure could come as soon as next week.

    Senate passage would send the bill to the House, where it would go through a subcommittee that includes several outspoken critics of legalization.

    Tamar Jacoby of the conservative Manhattan Institute, a proponent of legalization, said the fight in the House, if it occurs, �is going to be bitter. It's going to be hand-to-hand combat.�

    Hi
    I have a question with regard to AP renewal. My I-485 was sent to local office for interview in Feb 2009 and my case was preadjucated since the dates werent current , my card wasnt issued. I am in California. My PD is Nov 2005.

    The question I have is, when I filing for my AP renewal , do I still send it to Nebraska or some other office? Since I dont know the location where my I-485 file is located as of now.

    Any one who has renewed to AP/EAD after being called for interview at local office if they can give me any direction on this would be great. I asked my lawyer the same question he doesnt seem to have an answer as yet.

    From talking to dozens of people I have met in my MBA program, including folks from MIT, Harvard, etc my lesson tells me this:

    If you work in financing or executive positions - for example if you plan to work as a financial analyst at Wall Street - then yes, it makes sense investing in schools which are highly ranked.

    For those of us coming from IT related positions and now aspiring to move into project management roles, even IT directorship or CTO position, then ranks become very, very irrelevant. I agree at that point a good MS in information management or MS in telecommunications would be a better deal followed by inexpensive PMP type of courses which you could pay from your own pocket.



    If you get an MBA from Sloan or Wharton or Harvard or Berkeley, nothing like it. I know of few people who have not done very well after getting MBAs from these schools. If you want to continue writing comp. programs, then of course there is no need for it. But how many people want to do it forever?

    But I agree with Tito to some extent. Especially, if the degree is from even a slightly lower ranked school like Arizona or Northwestern, the returns are not there, and there is a great deal of evidence in that direction.

    Having actually studied this data (and being in the business of teaching) gives me some perspective.

    But it's still just my 2 cents.

    Please don't shoot me for these thoughts, but please consider it only for sake of discussion.

    Now that CIR is defeated again for nth time, We really need to consider rethinking about our stratergy,

    I guess we are about 15K membership and if we include spouse and take a guess every one in five has dependent kid to join (wild gusstimate) we come close 35-40K approximately.

    most of us are legal and we should not having any issue in getting Green card with current law only if backlog is cleared and we recapture visa numbers.

    to recapture visa numbers we don't need any legislative reform AC-21 does apply,

    We need to spend more energy in researching possibility of recapturing 90K visas and we will be done,

    I really don't think we have strength and will power to fight legislation change along with illegals for most controversial subject.

    we are legals letz use it our advantage.

    I never said anything is wrong, what we are doing is fine.

    I am just seeing posts where people are finding fault for not participating. No- Participation can be due to any number of reasons.

    About who is SELFISH or not...yes, there are people who dedicated everything for the benefit of others, look around, you may surely find people. I define selfishness as "if we do things for our own sensual enjoyment" and not "basic survival". Both are selfish but grossly and signficantly different.

    It is like eating the bare minimum to live and doing service to mankind or having a pizza party and just pretty much living for oneself oblivious of others.

    This green card is just about me and my family members (99%)...dont you think so?

    :eek: I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
    I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
    I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
    Anyone else has experience to share about TheChugh law firm?


    Even I have some bad experience with CHUGH Firm..They are really slow and never talk...I think they don't pick the call even if they are around...
    I'm not sure if my employer's told them not to respond to my mails..anyways itz very tough to get things out of them...
    and one thing I did'nt like in them is that they lie right on ur face !!

    I am a july 07 filer, and now its time for my AP renewal.
    I would appreciate if experts can give me suggestion regarding the AP Process?
    or point me to thread having a information, I remember in 2007 we used to have a thread/blog with screen snapshots for AP filing.

    My 485 is in Texas Service center.

    1) ANy restrcitions for filing AP Electroncially
    2) Fees
    3)If Paper Filing do I have to sent seperate cheques for me and my wife or a combined cheque.

    Check with uscis what happened to her application for transfer and you might have to contact attorney depending on uscis' answer.

    Not sure what you mean by this...

    I never said I agreed with country base quotas for EB. However; lawmakers, etc. are not stupid people. We have to try to understand why they are there and why it is not being changed. We have to understand the symptoms before you can find the cure.

    Your argument is that the country quotas help limit nepotism and discrimination based on national origin. However, this is already prohibited under DOL rules if you look at form ETA-750A. Therefore, if this is happening, it means there is a failure in the labor certification system to prevent this type of discrimination. Also, nepotism is not all bad as the Clintons and Bushes have been demonstrating :D.

    The country quota owes its origin and sustenance to deep national insecurities around race. It will change eventually as the makeup of the nation changes over time. In the short term we will see movement as the UK bumps up against the 7% limit.

    Will a part time MBA / executive MBA from reputed university do any trick for the existing H1b holders? I am not asking this for GC, but it is mere co-incidence with SKIL bill and my intention of doing MBA.

    The very first para in August 2006 visa bulletin says...

    This bulletin summarizes the availability of immigrant numbers during August. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; the Bureau of Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible under the numerical limitations, for the demand received by July 10th in the chronological order of the reported priority dates.

    MY COMMENTS:
    In may it was Apr'08, then it was Apr'15 and now it is again Apr'01. So when the dates are in April 15, more people have applied for 485(than I have imagined) to consume the VISA availability quota. I wonder, if those many people are there from 2001 April and before to consume the quota, then when will the datel move to May'01. Forget about the visa dates moving to July/Aug/..Dec 01.

    If the SKIL bill or any other provision is not passed into the law, it is always better to have a secondary plan to save the career at least. It is better to think our family and career assuming what we will be doing if the priority dates does not cross Dec'01 in the next five years.

    I personally think to move back to India if I do not see anything by march next year. Already I am in the end of seventh year. If the SKIL bill is not passed, I donot want to do a MBA here by spending 40K(partime ,100K fulltime) and then doing a sr.software er job. With the spagetti law, I cannot change my roles whatever qualifications I add after applying for my GC. I have been postponing the idea of starting my MBA for long time becos I would like to file my 485 before I work on that. Otherwise it is waste of time, energy and money. What a HELL...............

    IF the U.S Master's exception goes through, its pretty obvious that the DOS will tighten the screws on F1 Visa approvals by a magnitude of 100(unless F1 is made a dual intent visa... and that's like asking for the sky), and also USCIS will make in close to impossible to change non-immigrant visas status to F1( from say H1B). So it’s more than the 20K to get ahead of the line. The only benefit will be for folks already with a U.S Master's or it will be a new rat hole, fighting the Consulates/USCIS for F1 status.
