The absence of I485 receipt may be an issue, because they would put a stamp on that paper after taking your (I485) FP. They would do the same on your EAD FP notice letter.

Folks,
My wife got terminated on Feb 13th, she received her last pay stub on Feb 20th...We haven't applied for a COS till date...Is she now out of Status..??? She was waiting on her last paystub before she can apply for a COS and she received around 24th of last month and now we are all ready to send our documentation for COS to USCIS. During this span of 2 weeks is she considered staying illegal here..??
I was reading somewhere if USCIS receives her COS after her employer h1b revocation, she might be denied her COS...Is this true...??? Please Advise.
I was also reading somewhere about e-filing for COS, is e-filing available for H1 to H4 COS..??

Any advantage of opening an account on USCIS website to receive automatic case status updates? or I don't need to do that if I keep checking the status online by myself?

If you have multiple cases i-129, i-131, i-140, i-485 you can see them all on one page, I find that easier to see LUDs in particular the "soft" non-action ones, but it's nice to know the file was touched.

Hi,
I filed my EAD and AP renewal on Sept 17 (20 days) ago but still I haven't heard received neither receipt notice nor my check being cashed. Is there anything we can do to find out about the receipt notice? Fedex tracking shows the mail being already delivered. I am currently working on EAD and recently used AC21 to switch the company so EAD is very important to me.
Please provide your feedback and if anyone is having same delays in getting receipt notice for EAD / AP.

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824

Hello all, with the August bulletin showing June 06 cut-off dates, I have the following questions for which I seek input form IV members.
1. Is it possible to apply for the GC, the second time, if one cancels his GC "without prejudice"?
2. If yes, is it possible to use the priority date of the canceled GC in the second GC application?

I am asking this for my sister who is working under J1 (start in October 2007 and valid for 1 year). She already get a J1 visa stamp and re-enter US as J1 status
1. Change of employer is not permissible in J1. Can she submit a new J1 petition and thus ending her current J1 petition early?
2. How about the 2-year home residency requirement (HRR)? Does she need a waiver for the current J1 she is doing now OR can she satisfy the HRR after she finishes with the new J1? The new J1 will not end later than the current J1. So, practically she will be in J1 for 1 year only.
3. Does she need to get another J1 visa stamp and re-enter the US?

My PD is 08 july 2004. ND 08/09/2009 (NSC) and no approval yet. Multiple SLUD's from 4/2/09 - 04/16/09 on dependents and my cases after we sent response to RFE.
Last update was on 04/16/09.
Opened an SR on 09/03/09 and the wait goes on ...
Its furstrating to see the "Inorderly" and "out of turn" approvals ...
I don't want the miss the boat as PD later than me are using up the numbers.
There must be lots of IV members who are in similar situation.
Attorneys please suggest how we should tackle this.

I become a us citizen a couple of years ago. i was able to sponsor my brother to get an F1 visa. He will get a master degree in computer engineering in a couple of years. I would like him to stay in the us to work and live. i am thinking about filing an INS form I-130, Petition for Alien Relative. how the filing of i130 affect his non-immigration f1 status? what is his chances to get an h1 visa while he wait for the immigrant visa number (over 10 years)? can he go back to visit the family and reenter the us without an issue?

11) I have filed my 485 and 140 concurrently in august EB2 category from my current employer. The priority date of my labor is nov-2006.
Please provide me your guidance can i use my approved 140 PD (may-2003) in my filled 485.

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion
