Hi,
I am in weird situation. I left my previous employer because they didn't file for my concurrent filing during July '07 madrush.
They applied for my I-140 on 26th Sept 2007 thinking that I may change my mind and stay with them.
It seems that they didn't revoke my I-140. Since, yesterday, I got email notification from CRIS about I-140 approval.
Now a question for Gurus:
I am not sure but my previous employer may revoke it anytime. Based on the email notification and the online approval snapshot, can I port my priority date to my current application, with new employer, even if previous employer revoked my approved I-140 ?
Personally, I was happy with my previous employer except for the concurrent filing that they didn't apply. Now, I am in dilemma. should I should rejoin my previous employer or not?

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.I also heard same thing but talking to a attorney is good than posting here..

Yes. you can file i140 and 485 concurrently

My name is mistakenly typed in the form I-129 submitted to USCIS. In that form only, in all other forms(including i-129 supplements) it has typed correctly. So, it's reflecting in I-797 as venuKalangi(last/family Name), Venu((first Name). "venu" is repeated. My actual Name is Venu(first name),Kalangi(last/family name).
My petition is filed on apr27th'2010 and is in initial review now. Can you pls guide me what need to be done now. I'm a new applicant and my travel date is in last week of october. I heard that I need to apply for amendment, if so, by which form it need to be done and how much time it may take for correction or Can I go for stamping without amendment, is it causes any problem?

Call me insanely confused idiot, but here is a thing:
I work for a major MNC (of course pays me 15% less than I should be making). My boss is also leaving the company. At the same time, I am getting an offer from another local (small) company, better position and pay. My GC is pending PD Jul-05/EB2 India from MNC. Should I leave at the 11th hour?
Just to clarify both are consulting companies.

So this may be the last week of H1B visa filings, as of November 27, 2009, approximately 58,900 H-1B cap-subject petitions had been filed. USCIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Hi I'm a Moroccan citizen I was placed in removal proceedings (NY Buffalo) and took voluntary departure. once my wife's divorce was finalized we got married while on voluntary departure. we filed motion to reopen the case and it was reopened and transferred to Los Angeles, CA then the judge closed my case based on marriage with an I130 receipt without prejudice. The I130 was filed on june 2009 and was transferred to Los Angeles on November 12, 2009. I made an appointment with Info Pass but they just said you have to wait untill we call you. My lawyer said I can't file for the I485 untill the I130 is approved. My question is: How long will it take before we will be called for an interview?

She will have to go out of country and get stamping for H4 if her spouse is maintaining H1.
Automatic validation does not happen..
I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

My H1 extension was filed with regular processing and I got RFE too.
My office has replied to RFE and as per tracking it is delivered today.
any guess about following -

For a EB2 position, that requires a MS with no alternate qualification accepted:
1. Does the business necessity need to show how the job duties match the course work during MS or why the job duties are needed for the company?
2. Do we need to send the business necessity at the time of applying for PERM or only when audited.

Does anyone,please could help me with the following query?
If my I-140 is not approved yet, is Uscis touching my I-485 application....in other words is I-485 being processed (not approved, only processed)even if I-140 is not approved?( I applied concurrently in August 2007, and my priority date is current, Eb3 ROW).

New employer agreed to give me similar job duties in EVL & I am getting 40% hike. Is it wise to use AC-21 here?.

(1) H1b visa transfer process for physicians after residencies into a jobs
(2) How to handle licensing issues - murthy.com has some info, but we need a better perspective
(3) Green cards for physicians - eligibility and time frame and minimum requirements etc..
Any any other pitfalls or booby traps that one has to be careful about.
A lot of physicians do visit IV website - am wondering if there are any user groups or forums on web that discuss potential issues and other stuff that we discuss on IV.
