I was laid off in early April, and the employer told me that they would revoke my H1B 30 days later (early May).
Now finally I get a job offer. The new employer can start to work on my h1b now, but the starting date will be late July.
I have an EAD right now based on my approved 140 and pending 485 (>=180days)
I talked with my attorney, and he said I would definitely have to go back to re-activate my H1B abroad, so I should use EAD instead of doing H1B.
Is it true that I have to go abroad to re-activate my h1B? I saw some people transferred sucessfully
Any thoughts? Thank you very much.

Hi,
I just got back word from my lawyer saying that you shld be able to work with an expired EAD as USCIS would "backdate extensions of work authorisation" (provided of course that you have applied for the extension).
(I have been trying to upload the pdf, but can't seem to get it.
It's saved as a pdf on my local drive and am using the attachment icon provided, any help would be appreciated).
I know there are have been many nays on this subject and have asked my lawyer to provide more substantial proof (any memos or publications by USCIS).
Any comments on this?

My attorney has filed our AOS on July 30th. She didnt had time foR filing our EAD & AP. So I'm applying myself.
My wife was out of status and is under 180 days. Her AOS will be considered under 245(k).
Now to file her EAD & AP, do I need to attach any Cover letter explaining her status? or the documents that are required will be sufficient? Please some one throw some light and let me know how to proceed.

My parents will be visiting us here soon, and when they return, we want to see if we can send kids to India (2 and 5yrs). Kids have never been to India, and I would like to know which is a better option and why. Greatly appreciate your advice.

Hi- When I started off with the green card process, I had not idea about what most of the things meant. I joined a very reputable Fortune 500 company in 2006 (the same year I came to the US on a H1B), and started my GC process in 2007. The company offered me an pre-approved labor with a 2006 PD, which had a matching requirement w.r.t job description and salary.
During July 2007, i filed for my I-140 and I-485. Subsequently, my I-140 got approved without any issues. Now, given that my priority date is close to being current (2/14/2006), I'm afraid if using a pre-approved labor will have any role to play with my I-485 approval.
And no, I'm not working for a consultant. And I have been with the same employer since 2006.

According to CNN, America could be facing a nursing shortage that will worsen exponentially as the population grows older. The problem: Baby boomers are getting older and will require more care than ever, taxing an already strained nursing system.
Barry Pactor, international director of global health care for consulting company HCL International, agrees that more nurses should be trained within the U.S. system. But as a short term solution for this "huge shortage," he said the U.S. government should loosen immigration restrictions on foreign health care workers. "I don't see this as foreign nurses taking American jobs, because these are vacancies that already exist and cannot be [filled] by nurses currently in training," he said. "We'd be filling in the gaps until the training can catch up with the demand."

Most people have now heard about Stephen Colbert's testimony in front of the House Immigration Subcommittee this week on the subject of new laws for migrant farmworkers. Some have criticized the Committee for letting the comedian speak. I say, how high can the standards be if they let me testify? I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:
a) Between 8/15 and 10/1, are we out of status?
b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?
c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.
Any suggestions are welcome. Thanks.
