Hi Guys,
All my checks got cashed on friday....today my lawyer office got a notice saying that there is no FP fee eventhough they cashed it.
they asked to resubmit the fees again...my lawyer said he will work it out with them..
My questions is I filed to NSC, transfered to VSc and today they status says it has been transfered to TSC :confused:
So should i submit this evidence to VSC or TSC.
Please clarify.

Hi,
I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.
My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).
My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?
1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?
2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

EB-2 PD: Mar 03, Labor, I-140 approved.
then moved to company B.
Company B:
EB-2 PD: August 05. Labor, I-140 approved, I-485 pending.
Want to move back to Company A as Company A is willing to continue; so need to inter-file my I-485 from Company B to Company A. Did you guys do this before? If so, what is the procedure? How do we know if the inter-filing is succeded? Do you have any success or failure stories?

Hi,
I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.

I am on H1B all these days and my company wants me to mandatory move to EAD. (no option here). I also had my H1B approved for an other 3 years.
1) Is it a good idea to move on EAD now.
2)Its been close to 6 years on my H1 but I still have 8 months left on the initial 6 years. Can i use the left out period on H1B later.
3)Now that I am on EAD, if i need to move my employer, can I invoke the AC21. if yes what should I do... do i just need to resign at the current place and join at the company b.
4)If I move out of my current employer,Can my employer revoke the I140, considering that its already been more than 180days since approved.
Note: I have my 485 pending and 140 approved in April 2008 and I am a July 2007 filer with a priority date of June 24th 2007.

The A# that is listed on my I-485 receipt notice is different from the one listed on my approved I-140. In addition, the number listed on my I-485 receipt notice has only 8 digits instead of 9. From reading various forums, I've heard both sides of the story...some are saying that something like this needs to be corrected, and some others are saying that the A# is just a file number, and eventually gets consolidated.
I called USCIS customer service, but they weren't much help as they couldn't pull up the information in their system.
Any inputs? I'm planning on inquiring about this when I go for fingerprinting. Also curious to know if anyone's A# on their approved I-140 has nine digits, and if the one on the I-485 receipt notice only has 8 digits.

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.
Please refer to Yates Memo for AC21.

yes, you can add her anytime before the approval of your I485 (3rd stage of the GC process). You havent mentioned EB1/2/3 but if its EB2 or EB3, stage 3 is several years away for you, and you can always add her before you apply for the final stage. Good luck!

People suggest to work for 6 months...Remember there is no rule to work for 6 months. But just incase if somebody ask at the time of applying for citizenship, you can show that you worked for 6 months.

This may seem strange and confusing. Here is my case
I changed my employer from A to B with an intention of taking advantage of an existing approved labor with employer B. I applied for I-140 and H1B transfer at the same time in March 2007. I-140 was approved in June 2007. In July 2007, I applied for EAD and 485. Meanwhile, I got an RFE for H1b transfer and my attorney responded to this in time. I got my EAD approval in Sep 2007 and got FP done before my I-94 (thru company A) expiration in Nov 2007. I got a denial notice for my H1B on Nov 13 2007. My attorney missed the appeal date so no appeal has been filed for the H1B denial.
Here are my questions:
- Am I currently out of status since my I-94 expired in Nov 2007?
- If I am not out of status, what is the next course of action I should be taking?
- Will there be any issues when i try to renew my EAD?

contact the following people and ask what you need to do to file taxes:
1. contact employer
2. contact your payroll company (like adp, etc) that process your company's payroll
3. contact IRS helpline or customer service (including local or state tax dept)
4. contact experienced tax consultant (CPAs)
I thought employer should have arranged for duplicate one. if not contact above all people and find out what you can do about it.
