    Hello Gurus ,
    I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .

    Will I qualify for 3 year H1 extension based on my approved I-140 .?

    Background:
    We received AOS interview letters for attending an interview at the local USCIS office next month.

    Today, I received an email saying that "Notice Returned as Undeliverable" only for my spouse. We have not changed the mailing address and we are not expecting any docs from USCIS.

    Question:
    1. Who screwed up? Is it USPS or USCIS?
    2. What notice could this be?
    3. How would I resolve this (From a quick search, it appears that simply giving customer service a call will not help)

    Any help is really appreciated!!

    WASHINGTON, Nov. 23 — As President Bush looks toward his final year in office, with Democrats controlling Congress and his major domestic initiatives dead on Capitol Hill, he is shifting his agenda to what aides call “kitchen table issues” — small ideas that affect ordinary people’s lives and do not take an act of Congress to put in place.

    Over the past few months, Mr. Bush has sounded more like the national Mr. Fix-It than the man who began his second term with a sweeping domestic policy agenda of overhauling Social Security, remaking the tax code and revamping immigration law. Now, with little political capital left, Mr. Bush, like President Bill Clinton before him, is using his executive powers — and his presidential platform — to make little plans sound big.

    He traveled to the shore of the Chesapeake Bay in Maryland to announce federal protection for two coveted species of game fish, the striped bass and the red drum. He appeared in the Rose Garden to call on lenders to help struggling homeowners refinance. He came out in favor of giving the Food and Drug Administration new authority to recall unsafe foods.

    Just this weekend, thanks to an executive order by Mr. Bush, the military is opening up additional air space — the White House calls it a “Thanksgiving express lane” — to lessen congestion in the skies. And Mr. Bush’s aides say more announcements are in the works, including another initiative, likely to be announced soon, intended to ease the mortgage lending crisis.

    With a Mideast peace conference planned for the coming week and a war in Iraq to prosecute, Mr. Bush is, of course, deeply engaged in the most pressing foreign policy matters of the day. The “kitchen table” agenda is part of a broader domestic political strategy — which some Republicans close to the White House attribute to Mr. Bush’s new counselor, Ed Gillespie — for the president to find new and more creative ways of engaging the public as his days in office dwindle and his clout with Congress lessens.

    “These are issues that don’t tend to be at the center of the political debate but actually are of paramount importance to a lot of Americans,” said Joel Kaplan, the deputy White House chief of staff.

    One Republican close to the White House, who has been briefed on the strategy, said the aim was to talk to Americans about issues beyond Iraq and terrorism, so that Mr. Bush’s hand will be stronger on issues that matter to him, like vetoing spending bills or urging Congress to pay for the war.

    “It’s a ticket to relevance, if you will, because right now Bush’s connection, even with the Republican base, is all related to terrorism and the fighting or prosecution of the Iraq war,” this Republican said. “It’s a way to keep his hand in the game, because you’re only relevant if you’re relevant to people on issues that they talk about in their daily lives.”

    Mr. Bush often says he wants to “sprint to the finish,” and senior White House officials say this is a way for him to do so. The president has also expressed concerns that Congress has left him out of the loop; in a recent press conference, he said he was exercising his veto power because “that’s one way to ensure that I am relevant.” The kitchen table initiatives are another.

    Yet for a president accustomed to dealing in the big picture, talking about airline baggage handling or uniform standards for high-risk foods requires a surprising dip into the realm of minutiae — a realm that, until recently, Mr. Bush’s aides have viewed with disdain.

    After Republicans lost control of Congress a year ago, Tony Snow, then the White House press secretary, told reporters: “The president is going to be very aggressive. He’s not going to play small ball.”

    It was a veiled dig at Mr. Bush’s predecessor, Mr. Clinton, who, along with his adviser Dick Morris, developed a similar — and surprisingly effective — strategy in 1996 after Republicans took control of Congress. That approach included what Mr. Clinton’s critics called “small-ball” initiatives, like school uniforms, curfews for teenagers and a crackdown on deadbeat dads, as well as the use of executive powers to impose clean air rules, establish national monuments and address medical privacy.

    “People in Washington laughed when Mr. Clinton would talk about car seats or school uniforms,” said John Podesta, Mr. Clinton’s former chief of staff. “But I don’t think the public laughed.”

    Nor does the public appear to be laughing at Mr. Bush.

    When the president sat down at a rustic wooden desk on the shores of the Chesapeake last month to sign an executive order that made permanent a ban on commercial fishing of striped bass and red drum in federal waters, people in the capital barely took notice.

    But it was big news on the southwest coast of Louisiana, where Chris Harbuck, a 45-year-old independent financial planner and recreational angler, likes to fish with his wife and teenage children. Mr. Harbuck is also the president of the Louisiana chapter of the Coastal Conservation Association, a nonprofit group dedicated to conserving marine resources; Mr. Bush’s order is splashed all over his latest newsletter.

    “We were very thrilled with what he did,” Mr. Harbuck said.

    That is exactly the outside-the-Beltway reaction the White House is hoping for. Mr. Bush’s aides are calculating that the public, numbed by what Mr. Kaplan called “esoteric budget battles” and other Washington conflicts, will respond to issues like long airline delays or tainted toys from China. They were especially pleased with the air congestion initiative.

    “You could just tell from the coverage how it did strike a chord,” said Kevin Sullivan, Mr. Bush’s communications counselor.

    Yet some of Mr. Bush’s new initiatives have had little practical effect. Fishing for red drum and striped bass, for instance, is already prohibited in federal waters; Mr. Bush’s action will take effect only if the existing ban is lifted. And the Federal Aviation Administration can already open military airspace on its own, without presidential action.

    Democrats, like Senator Byron L. Dorgan of North Dakota, who runs the Senate’s Democratic Policy Committee, dismiss the actions as window dressing. “It’s more words than substance,” said Mr. Dorgan said, adding he was surprised to see a president who has often seemed averse to federal regulation using his regulatory authority.

    “He’s kind of a late bloomer,” Mr. Dorgan said.

    Mr. Bush, for his part, has been using the kitchen table announcements to tweak Democrats, by calling on them to pass legislation he has proposed, such as a bill modernizing the aviation administration. The message, in Mr. Sullivan’s words, is, “We’re not going to just sit back because they’re obstructing things the president wants to accomplish. We are trying to find other ways to do things that are meaningful to regular people out there.”

    [B]I came to US on March 28th 2008 on H4 Visa and applied on March 29th for new H1B with COS for Oct 2008 quota. I see the h1b approval of I129 petition on Jun 2, 2008 WITH attached I-94 WITH IT. Till today I have not received approval notice from my employer and did not applied for SSN and has not started working for my employer. On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .

    My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

    Hi everyone, I applied for H1B last year and my employer said my application was not selected in lottery. This year a different employer is applying for my H1 and the lawyer today told me that I already have an approval and gave me a receipt no. When I checked its status online, its - 'Approval notice sent on 29th August 2007'.

    I wonder how this lawyer is saying this is my approval, eventhough I was told by my employer last year that I didn't made through lottery. And now this lawyer is asking for the copy of that approval which I am not at all aware of. If I knew I already have the approval I wouldn't be applying again this year.

    How did this lawyer found out about my approval receipt? Is there a provision for them to check? Will it be illegal if my application goes again, with an existing approval. I have never been to USA.

    Please suggest, what should I do.

    I re-entered the country using Advance Parole. I applied for H1 extension after the reentry and I have the approval notice with the I94 attached to it.

    EAD renewal questions:
    Manner of last entry - I think it should be Advance Parole
    Current Immigrant status - Not sure if it is Parolee or H1?

    Please help and reply if you have filed EAD in same case and got approval. Thanks in advance.

    This is one of those odd weeks when Congress may actually work. Both houses are likely to pass Democratic bills to expand SCHIP, the children's health coverage program. Yesterday, the House enacted lobbying reform, and the Senate may follow suit tomorrow. Also yesterday, the House passed a bill restoring the right of victims of pay discrimination to sue their employers.

    In short, it's one of those weeks when Nancy Pelosi has no doubts about the wisdom of her decision to become speaker of the House.

    "What's it like?" she asked herself, beaming, at the conclusion of a breakfast meeting with roughly 20 liberal journalists yesterday morning.

    "It's fabulous! Absolutely fabulous!"

    It can't always be thus. Her biggest frustration, of course, is Congress's inability to end the war in Iraq, which she terms "a huge moral catastrophe for the country." It is the public's biggest frustration as well, she says, and the main reason that popular support for Congress has plummeted.

    In September, Iraq will once again be Congress's chief item of business, when Gen. David Petraeus delivers his state-of-the-war report.

    Pelosi (understandably, given the administration's mountain of misrepresentation on all war-related matters) is wary. "The plural of anecdote is not data," she said. "I'm very concerned they'll pass off anecdotal successes as progress in Iraq."

    The question in September will be whether congressional Republicans continue to support President Bush's open-ended commitment to keeping U.S. forces in Iraq while a civil war rages around them. To date, the Republicans' strategy, and not just on the war, has been to thwart the Democrats at every turn and to use the Senate's 60-vote supermajority requirement both to create a "do-nothing" Congress against which they can run and to spare their president from having to veto popular legislation. (Why they care about sparing Bush -- he will never face voters again; they will -- plunges us into the murk of abnormal psychology.)

    The GOP strategy is not without its pitfalls. Republicans have succeeded in tanking Congress's approval ratings, but polls consistently show the public, most importantly in swing districts, preferring Democrats to Republicans. With this week's vote on expanding SCHIP, though, Democrats are convinced that the price of blocking health care for uninsured children is more than many Republicans are willing to pay. Bush has vowed to veto the legislation; Pelosi, noting with an almost incredulous glee that the administration will stand athwart children's health care on the grounds of opposing a higher tobacco tax, says, simply, "Welcome to this discussion."

    Not all discussions, even in a good week, are so pleasurable to anticipate. Asked about the resolution that her congressional colleague Jay Inslee of Washington has introduced to impeach Attorney General Alberto Gonzales, Pelosi put her hands to her temples as if to ward off a headache. For the past year, Pelosi has made clear to her colleagues and the public alike that she has no interest in pursuing the impeachment option, though Gonzales is certainly doing his damnedest to change her mind. She remains unpersuaded, believing that impeachment would fail and in the process would make weeks such as this one -- a week in which the public's business is at last getting done -- far more uncommon than they already are.

    Pelosi understands the gravity of the damage that the administration has done to the Constitution and why that has impelled some of her colleagues to advocate impeachment. "If I were not the speaker and I were not in Congress," she said, very quietly, as she concluded her answer, "I would probably be advocating for impeachment." But the consequences she foresees from stopping the nation's business for an unwinnable fight outweighs those considerations.

    Pelosi deserves considerable credit for holding her party together on a range of divisive issues, but she plainly views the coming fight among House Democrats on fuel efficiency standards as irrepressible.

    The energy bill the House will pass this week contains no provisions that would raise those standards; such provisions, if any, await the outcome of a battle between Pelosi and Energy and Commerce Committee Chairman John Dingell, the Democrat who has represented Detroit and the auto industry in Congress since 1955 (that is, before tailfins).

    "I respect all our chairmen," Pelosi said. But the legislation, she continued, isn't about them. "It's about our children's ability to breathe clean air. Nothing less than the planet is at stake. I love him [Dingell] dearly, but we have to prevail. . . . The forces at work here [against stricter standards] are rich and entrenched," she concluded, "and it takes just a few [votes] to prevent us from unleashing the future."

    Thus, the most elegant of happy warriors, in a week when it's fun to be speaker.

    Can a person join a new employer for doing his LC, based on already sent out ads ???

    what they are telling me is that the ad is very general for EB2 which was sent out even before one joined the company. so my question would be that can a person go ahead and use the already sent out ads or one should raise some red falgs, not to go for it ???

    Please report your employer to DOL for discriminatory pay practice, if you think the pay difference is solely 'cause of your immigration status.

    And yes, you can change your job when you want through AC 21.. please browse the forum for AC21 process...good luck!
