This is a different employer, so I am assuming it is new H1. If I remember correctly from my past research, H1 is always NEW when you file it with different employer, but I am not 100% sure....

even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
i would be very careful about making such an argument.
if this is true in IT then the opposite argument is perfectly valid (and that is the one USCIS/DOL will accept) - that the folks in EB2 are not doing a job that needs an advanced degree and they should be in EB3.
and if this is true:

I saw a petitioner recommend GT law in one of the posts. I think she is a lot luckier than me. I have had very bad experience with GT Law recently. Please see the following facts:
1) After 3 months, I was only informed that my salary is not meeting the prevailing wage requirement; 2) After 6 months, I was told that the attorneys are still struggling with the job description themselves without asking earlier for a conversation with my manager to help them resolve the problem. The issue they are struggling is that the field of my advanced degree is not related to the field I have been working in even if my skills sets fit right in!!! Can you believe it that we are actually advising them how to handle this issue and paying them a lot of money???? 3) During the 6 months, the attorneys have been changed twice and the transition of my case from 1 set of attorneys to another was very poor (I was asked for the same set of documents twice). It seems the process started all over again with each change. With the most recent set (the 3rd) of attorneys, they sent my files to the Maryland State to assess my salary level last week after we were informed about salary issue 3 months ago by the 2nd set of attorneys. It has been really a big mess. It has also shown that different sets of attorneys are definitely not talking. 4) When I check with them once every two - three weeks about progress, they would never give me a clear or meaningful answer even though they responded pretty quickly. They don't even want to tell me what has been the maximum processing time of all the labor certification cases they have handled. Now, after 6 months, my job advertisement has still not been launched yet and I have no idea when it will happen. BTW, GT Law is contracted with my company and I am required to use them for labor certification. Now I'm thinking I will have to change to a different company if I want to get it done quickly and successfully.

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.
Sparky I had same experience in 2003 only my next flight was after 24 hours. I have never flow AF since that day (even if their tickets are cheaper) and neither has any of my friends or family member. I support this, and am ready to contribute $, time and sweat. We need visibility. Our main goal is to EDUCATE people, (and even the government!) that we are the totally opposite of illegals! The Congressman who spoke at our rally had a lot of good intentions, but then he started talking about how "illegal immigrants are also people who look like me"(meaning Caucasian/White) and he mentioned the thousands of illegal Irish immigrants living in Boston, who have a group called "Legalize the Irish Now".... those comments had no place in our rally of highly-skilled LEGAL immigrants! And that was a Congressman talking. EDUCATION IS THE WORD, and we need to invest in it NOW!! Let's go guys! Ideas!???
I fully empathize with everyone in this forum languishing in the visa backlog - i am in the same boat myself. But I don't understand the impulse to talk down the illegals who are in a much much worse position than we are in! it would help a lot to refrain from taking unnecessary digs at people who do the thankless menial jobs no one else does. the anti-immigrant machine is very very sophisticated with millions of dollars and foot soldiers at their disposal - fudging the difference between legals/illegals when it suits them and scuttling any reforms to ease the ugly & racist eb backlogs in the background. IV has done a commendable job so far in taking it on in a dignified way with Mahatma Gandhi style protests and rallies - please don't taint it with unnecessary digs at the illegals - they are as deserving of a fair shot at the american dream as we are. that said, i fully support kicking everyone in the butt and getting something done to eliminate the backlog - even well publicized volunteering may help apart from another rally

1. Let us decide how we need the data. ie what query USCIS has to run
2 make publicity of this .. ie uscis is an agency which should have the data but it is asking us to pay 5K for the data. (president, hillary clinton, aila and whoever else,...)
3 Only getting this data one time wont help us. Like USCIS processing dates , they have to run our query every month on a particular date and publsh it. Otherwise after 6 months or one year we have to pay this money again.
4 Can we appeal to the money asked by USCIS. Anyone who knows more about FOIA
5 Can we request USCIS to give us the table details and tell them we can write the query/program free of cost.
Any other suggestions..

I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)

We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. Let's double-check -- out of 1.2 million cases ready for action, about a half is naturalization, and from the other half, ~13% would be EB - yep, 80K (EBs are the easiest to approve because there are no interviews or tests, so the percentage is likely less than 13%).
So, in March 2007 there were a total of no more than 140K pending cases in I-485 stage of stocessing. Now in June-August EVERYONE who had an approved LC got to apply, and there were ~300K applications, while CIS gave out ~70K green cards, so we would have a total of 370K pending petitions. This estimate is surprisingly close to 13% of the total 2.5M backlog, so I would consider it good.
Again, I absolutely do not believe there are more than 500K EB1-EB3 cases. There may be another 500K in the 'other worker' category, but this is not what we are talking about here.
We can argue who is right on the numbers for a long time, The Ombudsman, who quote that they can not say for sure what the numbers are, or the kauffman Report who claim 1.1 million. Even if we go with your number of "no more than 500K" - thats a 3 year wait if there are no more country caps.
Also from the Ombudsman:-
"In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards." - Pending applications for employment-based green cards means "application approved pending visa number availability" - ie all but approved - waiting for a visa number, not all 485 applications.
"As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending"
I'm obviously not adding those numbers together, but I really believe that the numbers are larger than we think.
Remember to take out the visa's unsued each year (per the ombudsman, in the last 3 years, thats only 100k wasted) that brings down the number of visas available, and remember there are other visa paths into greencard application, not just H1B.
They also think there are roughly about 170K at BEC... that haven't hit yet. Add that to the number - all with old PD so you better believe their dates will come current sooner.
If you've read the Ombudsman's report, you should have figured out that things are NOT moving quickly

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

I did my masters here.I got my first job at Company A.They sponsored my h1b through masters quota and was working till feb 2007.Now I transferred my H1b to company B .Things are not working now with Company B.I have all the paystubs of company B

I want to know weather can I apply AP for my wife while she is in US post it to India if she has to go to India before it gets approved.
