    Is there any update on administrative fix for filing the adjustment of status (485) without priority date being current. As this will be an important measure as well for those who miss the oppurtunity last year.

    This fix would help definately relieve stress for our better half as well......

    My wife was on H4 before and since Oct 2007 she started working on H1. Since we haven�t had a chance to go to our home country, her H1 is not yet stamped. She is thinking of switching to some other company. Can she transfer her H1 without having a stamp?

    Based on Visa Bulletin report, it seems like massive retrogression is likely for EB3 as well as EB2 :( for the rest of the year. Many have ported and some hibernating applications are now active. :(

    This is something a texas IV aspiring member has to go through. I am sure Amma was the participant of one of the successful lawmaker meetings. There is something wrong here when IV is so harsh on a contributing member like Amma.

    Lets be fair here. RSVPing and not showing up is rude & unprofessional, and unbecoming of so called 'high skilled immigrants'. Its besides the point that the concerned members are contributing. Not to pick on any one member, but you can always call up to let the organizer know that you have a last minute conflict come up and will not be able to make it.

    I was Dem leaning too, and I liked Hillary. But Obama has in no way been running the honorable campaign. He is using others to do his dirty job, if you think otherwise, you too have been sold on the propaganda of the left.

    when obama made a sexist remark, what did the press do? Nothing. Let us see what happens if his opposition makes a even a hint of racist remark. I am sure then that the republican campaign will be pounded by every media outlet in the country.

    Again, not to say I like republican ideology, I am very left leaning in my thoughts and actions. However at this time, I see that majority of the left is leaning towards Obama just for the sake of leaning towards left, and not on the merits of candidacy. And such thing is bad for everyone concerned (even the world, because like it on not, what happens in USA doesn't just stay in USA) -- Obama has already demonstrated that he is nothing but a political opportunist. His comments on Israel (I liked his statement, but not his intention) and the eventual recanting, and among many other examples, shows that he is just unqualified to be the President.

    And for the records, McCain in not running for the job just based on the fact that he was shot down. He has considerable amount of experience working in the Senate and knowledge of world issues, and American issues too.

    Give me a break. McCain is running a honorable campaign and Obama is running a dishonoSrable campaign. Can you give me an example close to the "teaching sex to kinder garden" sleazy ad from McCain camp?
    What is the sexiest remark? Can you explain? Media pounding on Republican? Oh yeah we saw them pounding on Bush when he ran in 2004. I remember how the media ran stories of kerry shot himself in the foot to become president. And all those pundits asking 'who do you want to have beer with' stupid questions. And I remember the left leaning media pounding on the non issue pastor wright.
    Obama is a political opportunist while McCain is a saint? Do you know who said this "I didn't decide to run for president to start a national crusade for the political reforms I believed in or to run a campaign as if it were some grand act of patriotism. In truth, I wanted to be president because it had become my ambition to become president. I was sixty-two years old when I made the decision, and I thought it was my one shot at the prize". John McCain. And what does he say now "Even in retrospect, he would choose the path of retreat and failure for America over the path of success and victory. Behind all of these claims and positions by Senator Obama lies the ambition to be president. What’s missing is the judgment to be commander in chief." He is your saint?
    Saint or no saint, we don't want 'drill baby drill" guys and "God is running this war" nuts in the white house. You will have more problems in the economy and useless debates on abortions. We need to push them in the right direction and demand them they carry through their promises. We may not have the right to vote, but the outcome of this election will impact us and around the world.

    I don't like getting my ass kicked. Hence, I refuse to fly Air India.

    Last time I flew that Airline (Boston - Heathrow - Mumbai):
    1. The crew disembarked at Heathrow. The transit passengers were not allowed to disembark.
    2. The crew shut off the heat/power and opened the Aircraft doors (yes, it was winter).
    3. They sent the cleaning staff in to clean/vaccum the plane with a lot of passengers seated.
    4. At Mumbai, the airhostess was in some sort of a hurry shoving the passengers so that she could disembark first.

    I've never had such experiences with AF. They are not racist. Airlines are not allowed to issue transit visas and anyone who has lived in France can tell you how insensitive and lazy their bureaucracy is.

    Bad flying experiences do not equate to racism. It is strong word to use and I do not think it applies to this case. Yes, I have seen French show racism towards Africans, but this is not one such case.

    There is a reason why Indians are required to take a transit visa. Coz, in the past there have been Indians (at EU airports) who have claimed that they have lost their memory, do not remember who they are, don't have any ID and hence qualify for asylum on medical grounds. Now these gov'ts are requiring ALL Indians to have a transit visa so that if anyone pulls such antics, they have all the information that they need to identify the individual and deport. Some bad apples have f&^%ed it up for all of us.

    I agree on your points of AF following the process.
    But the burden here lies on the Airline Carrier, regardless of whether Indians have suddenly lost their passports or their memories, you simply cannot categorize everyone.

    And this exact attitude is why we dont respect each other.
    Oh, he is acting of being ill, or he is acting that he lost his passport. OR that indian is just lying that he never got his transit visa.

    Even if this was true, it is the airport authorities at CDG or AF staff that should be managing that. Bcos of some history, every indian was treated like a dog?

    And it is shitty that you are siding the AF guys, when your countrymen were illtreated. The attitude should be, I will first take care of my own brother and believe what he says, rather than going into the righteousness, which can be bent.

    I will bring an incident from the Clinton administration.
    There was this american arrested in Singapore for eating and spitting chewing gum on the streets of the city.
    The president personally called the PM of singapore and got this person out, who was just an ordinary cirtizen, who actually had broken the law of another country.

    So, I will believe whatever the Indian is saying over what the AF guys is saying. period.

    If you friends spouse was on H1 then i think her current status with USCIS would be H1.

    Since she is not working with the current employer she need to do the following things to void H1 status.

    a) Start using EAD to work.
    b) Use AP to re-enter the country.
    c) Get H4 status change.

    Otherwise her current status would be in H1.it could create some problem if beyond couple of weeks.

    You are talking about rights as if you are a citizen of this country. Constitutional rights are given to the citizens of the country. It is not your right to stay in this country. Legally it is your employer who wants you here and petitions for your Greencard. Now can you get your employer to talk to your congressman or media or file a lawsuit for you?

    There were some folks talking about lawsuit 3 months ago after the visa bulletin. That thread ran 9 pages and nobody did anything. 2 months ago again people talked about lawsuit and hunger strike. Nobody did anything. So it is not going to happen. Are you willing to spend thousands and keep going to courts or testify? Are you ok with your greencard application be used as an example and allow USCIS to scrutinize it?

    This talk about lawsuit is all gas.

    "Like citizens, aliens are protected by the U.S. Constitution, including the Bill of Rights and the due-process clause of the 14th Amendment".

    Its altogether a different matter if this lawsuit thing will move forward or not, but your point of contention is not correct.

    If you pay a closer attention, I don't start threads. I just reply to messages following that topics you started. The real issue is that many members in this forum are so biased that you cannot take a different view.

    For example, yesterday many in this noble forum became so uneasy and angry as soon as I mentioned that shift from democrats to republicans was triggered solely by the disatisfaction with the Iraq war. It turned out that Bil O'Reilly last night said the same thing. That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.

    What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take you greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

    I already mentioned in my previous posts (multiple posts with same matter for people like you and me, see it and understand it well) how we are getting more than 50k visas just for EB2 India. I am giving it here again the visa allotments for 2006 and 2007 years when theres vertical fallouts. Now its changed to horizontal fall outs.
    Due to this as many of us think its not the EB3 India which is losing, but its EB3 ROW.

    Class --------------------------------------> 2006 | 2007

    Total Employment-based Approvals ----------> 159,081 | 162,176

    EB1 ---------------------------------------> 36,960 | 26,697

    EB2 ---------------------------------------> 21,911 | 44,162

    EB3 ---------------------------------------> 89,922 | 85,030

    Fourth:-------------------------------------> 9,539 | 5,481

    Fifth (investors) ----------------------------> 749 | 806


    See the Total Employment Based Visa approvals for 2006 and 2007 159,081 and 162,176. But there are only 140,000 visas in EB category. The rest of the visas came from Family Based visas which are not used for the previous fiscal year. The share for each category: Each EB1, EB2 and EB3 should get 1/3 of 140,000 = 46,666. But due to the less demand in EB1 and EB2 ROW all the visas falling to EB3 ROW due to the Vertical falling.


    EB1 ROW --> EB2 ROW --> EB3 ROW.

    EB1 INDIA --> EB2 INDIA --> EB3 INDIA.

    As theres not much demand for EB1 ROW and EB2 ROW, all the unused visas are going to fall to EB3 ROW. So from this time its going to be like Horizotal fall out like below.


    EB1 ROW/EB1 INDIA --> EB2 ROW/ EB2India/ EB2China-->EB3ROW/EB3 INDIA.


    So this time to fall any VISAS into EB3 ROW they have to pass through EB2 India/EB2 China. So this makes EB3 ROW dates would retrogress due to the decrease in visa numbers availabilty.

    As I said each category would have 46,666. So EB1 and EB2 together will have around 93,332 visas. But in EB1+EB2 in 2006 about 50,000 visas approved and in 2007 about 70,000 visas approved. So for 2008 also asume the demand for EB1 and EB2 is 70,000. But the availability of VISAS are 93,332 as said above + unused family visas which come around 19,000+.

    So for this 2008 fiscal year for EB2 India and China the total visa numbers availlable are


    (93,332 +19,000) - 70,000 = 42,332.


    So around 42 thousand + 9,800 (regular 7% of 140k) = around 52k Visas Just for India , because EB2 China was already Jan 2006 a year back. And I dont think it would take any considerable share in this 50k other than its regular 9,800 visas.


    Get me back if you have any doubts.

    I think this makes complete sense. If USCIS continues with the same intent/logic from this point on then 50k visas is possible. We can argue over a few thousand here and there but the increase will be substantial as compared to prior years. The big caveat to all this is that USCIS/DOS continue the horizontal spill over from this point on.

    My MTR was reconsidered--what a relief. Here is the response:

    "Service motion to reopen or reconsider:
    In the case at hand, the I-485 was denied because the underlying I-140 was revoked. However, the applicant is eligible for portability consideration under Ac21. Therefore, the applicant should have been notified of this eligibility before any final adverse action was taken on his I485. Pursuant to Part 103.5, Title 8, Code of Federal Regulations, the denied I-140 petition referenced above has been reopened/reconsidered."

    My attorney says that what this means is that only my I140 that was revoked is now open and they have yet to make a decision on I485.

    My question to fellow members of this forum:
    1. Has any of you recived similar response to your MTR filing against wrongful I485 denial
    2. Please note that my case is slightly peculiar in that the I140 was revoked and aproved labor certification was substitued--if some one was in similar situation, please respond with specifics?

    My MTR was recieved my TSC on Feb 9th, i received receipt notice on Feb 16th and final approval was made on March 10th and the letter arrived on March 16th. I am glad and thankful that they understood the urgency of my situation. Now the hunt starts for NEXT STEPS?

    Entering the weekend before his midterms, George Bush and his party appear fated to lose the House they have held for a dozen years. The Senate is on a knife's edge.
    The latest polls continue to show that by 52 percent to 37 percent Americans wish to see a Democratic takeover. Approval of Congress has never been lower. Americans think the nation is on the wrong track. Support for the war in Iraq has collapsed to a third of the nation.

    What went wrong? Certainly, on three traditional Republican issues � strong military, conservative judges and lower taxes � the GOP remains America's Party.

    How do we know? Because no Democrat in a close race is calling, Mondale-like, for higher taxes or attacking Bush for elevating judges John Roberts and Sam Alito to the Supreme Court. In the tight Senate races in Tennessee and Virginia, Democratic nominees Harold Ford and Jim Webb are outspokenly pro-defense.

    On immigration, where Bush aligns with Kennedy-McCain, his party has abandoned him. The Republican House stands for border security, no amnesty and no new guest-worker program. Nor is this a losing issue. Even Hillary Clinton voted for 700 miles of security fence on the Mexican border.

    What, then, are the causes of Republican malaise?

    First is the perception the GOP is no longer a virtuous party that seeks to live up to principles and a high standard of public ethics. The adventures of the Abramoff Gang, Mark Foley, Duke Cunningham and his poker-party pals, of pork barrel and bridges to nowhere have demoralized the Republican base and disgusted Middle America. There is a feeling, even on the right, that if this crowd is run out of Dodge, its expulsion will not be unwarranted.

    Second, while the macro economy seems to be firing on all eight cylinders � the Dow has risen above 12,000, and the Misery Index of inflation plus unemployment has fallen to the lowest levels in modern times � not all Americans are participating in the prosperity.

    Employment in health care has grown by almost 2 million, but some 3 million manufacturing jobs have vanished. There has been a population explosion among billionaires, but the real median wage of a male worker has not risen in decades. The daily closure of factories here, as more and more Chinese goods show up at Wal-Mart, points to inescapable consequences: The price of the GOP's free-trade-uber-alles ideology is the loss of the Reagan Democrats.

    In Ohio, which was indispensable to Bush is 2000 and 2004, free trade is a millstone around the GOP neck. If Bush loses the House or Senate, free-trade globalism goes on the shelf. Not only will Bush fail to win congressional support of a Doha Round trade treaty, he will be denied any renewal of fast-track authority. The new Congress will not rubber stamp trade treaties, but demand a voice and votes on any new deal the Bushites negotiate on behalf of Corporate America.

    But if Republicans are swept from power, the reason will be Iraq. By two to one, Americans have reached the conclusion that the war was a mistake, that taking down Saddam was not worth the price in blood, that the management of the war has been as botched as John Kerry's joke, that it is time to bring the troops home and let Iraqis do the fighting for their own freedom, democracy and independence.

    And the more seats Republicans lose Tuesday, the greater will be the pressure on the party and president to find an early exit.

    Yet about the war, America remains divided and conflicted. For the roaring Republican reception to Bush's calls for "victory" testifies to another truth. While most American wish we had never gone in and want out, America does not want to lose the war as we lost Vietnam.

    Neither party knows a way to accomplish what America wants: to leave Iraq without losing the war. And the reason neither party knows how to do it is because it cannot be done. Like a patient suffering from cancer, we want an end to the "chemo" � the awful news daily coming out of Iraq � but we do not want the consequences.

    What, then, has cost the Republican Party its patrimony?

    The answer is, first, hubris. Dominating Congress for a dozen years, the GOP began to behave with the same haughtiness as those they displaced. They forgot who sent them here, and why.

    Second, ideology. Bush Republicans refuse even to reconsider, despite contradictory evidence, what their ideology teaches: that free trade is best, that U.S. power is invincible, that all the world wants to be like us, that our motives are always pure and theirs malevolent.

    Tuesday will bring the party back to earth. But it will not solve the crises that beset the country. For while the Democrats may be the political alternative, the Democrats' ideology of big government liberalism is even more bankrupt.

    May be you do not know the meaning of three red dots for TheOmbudsman (it used to be two red dots this morning), which is "so many IV members do not like his postings" i.e, TheOmbudsman is "anti-IV"

    FYI, if he does not like a posting with the word "CIR", why can't he ignore the post instead of replying to it with an assumption "people who mention CIR supports amnesty".

    IV members support CIR just because it has EB reliefs (manager's amendment) - is it not simple enough to understand?
    As someone pointed out from TheOmbudsman's posting, what "Rumsfeld resigning" has to do with immigration? What food you get from here?

    Companies were vague on numbers. So how could they satisfy Senators. I knew only a few companies gave detail about open positions including Microsoft, Intel and oracle. How you can impress Senate or house? But anti immigrants gave all the layoff numbers, h1b numbers used and details of abuses happened for past few years. It is not just money power will win. With facts and numbers if you have money power then you can win. That is reason for past 3 years H1b numbers or GC numbers were not increased inspite of heavy lobbying.

    This guy's a congenital pessimist.

    Experts,

    I have done e-filing for my AP renewal. I read the instructions to see what documentation I need to mail,but I did not find any documentation specifically for e-filing. Does this mean that there is no need to send any documents? I heard USCIS will take picture during biometrics which is all they need. Can you please share your experiences on this. thanks a lot.

    A friend of mine transferred his H1b from company A to company B. He applied for the H1b transfer and then started working on company B. His H1b from company A expired while his petition was pending with USCIS. He received an RFE after 3 months. Company B responded to RFE but received one more RFE for the previously responded RFE. Now my friend fears that his H1b transfer petition may be denied. Would it be possible for my friend to return to company A and apply for H1b under premium processing even though his H1b with this company expired couple of months back? He has been working all this while on the basis that his petition is still pending with USCIS. Any suggestions or advise would be much appreciated.
    Legally you can start working for company B once you get the receipt.

    think there is no limitation on number of H1's filed for one. so you can go back to company A for the H1 or go to a new company C for that matter.

    and as always get a lawyers opinion.
