My 'Employer #2' H1B I-94 and 'Employer X' H1B I-94 numbers matches with I-94 number that I got at 'POE'.
Receipt Data is July-2006 for 'Employer X' H1B.

Could you please provide following info
1. I-797 dates for Employer 2 and X
2. Last Date of entry in USA
3. Date when I-485 was filed
I-94 number being same does not mean much. One can have same I-94 number for COS from H1 to F1. On the other hand, one can have different I-94 with H-1B transfer. Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.
If beneficiary's initial H-1B was counted against cap in last 6 years, then subsequent H-1B petitions are not subject to cap and usually referred as H-1B transfers.

Hi all,
First I thank IV core team for making the D.C rally a big success.
Here are few of my thouts.
1)To get more chinese and other foreign nationals involved in our team we better to put active chinese and other nationals in IV core team (Its just my idea and if you think its not a good one please ignore it.)
2) Yes we better do a second rally but at thesame time we better to educate them first by giving adevrtisements and things like that.

How do you check the comments when someone REDs you? I've been looking around but haven't found the link.
Try to add reputation to yourself, you will see all the Greens/Reds given to you for that comment, along with the comments on the reds.

If its a transfer, your I-94 "number" will be same. Check to see if you have same I-94 number on any or all or atleast 2 of your I-94's including the one which they provided you at POE "across" any of your employers (1, 2 and X).
You can also check the application receipt date on them.. see if they are around April of those years? Most probably they will be new filings if the receipt date is around April oppose to September or November.

My I-140 was filed on July 6 and arrives at USCIS on July 9.
The check was cashed on July 12 and I was able to get the receipt number. BUT BY NOW I HAVE NOT RECEIVE THE RECEIPT. It seems many people are in the same boat. What we can do about it?
Anybody knows how many days it would take between they cash the check and mail out the receipt? What address do they use?
Did u get the receipt number on the back of the cheque or did u call USCIS and get it ???

Now that Democrats in charge, I think that there may be a chance Republicans might in fact be eager to pass Immigration related bill in house before they go out.
The president wants to have this bill passed for 2008 elections. In 2004 he made big deal on Soc Sec and immigration issues. Soc Sec is dead. So in order to show that he accomplished something he would like to pass immigration bill. He has shown eagerness to do so. Looking at another way, it must be clear to Republicans that they may have over-estimated public's anti-immigrant sentiment. If they don't pass the immigration bill now, democrats will get full credit for immigration reform.
So I think that unless there are more important issues, we might have a chance.

Actually, it was published in every major paper in the US, as well as in India, China, Canada, and a number of other countries. It was this broad coverage that led to the New York Times editorial. I have also seen mention of it on several news TV channels. And more is to come. The LA Times will be doing a story very soon.

I am very sorry to hear about your case. As others are pointing out - it is not all over yet. Make sure you get in touch with a good lawyer and take a good route to fight USCIS.

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.

Again, gapala, understand this, if old I-797 is not canceled, beneficiary is authorized to work for old employer for I-797 validity dates. I have recently applied for my H1 extension and have recieved the reciept. My current H1 is about to expire.
Can I apply for AP. (Assuming USCIS looks at my AP application before my H1 extension is approved)

We are here legally. We follow all the rules, contribute. :)
With you buddy, if they are getting benefit that easily or they getting in our way. i have no problem if illegals get GC if they pay back-taxes equal to the average amount paid by legals + fine for breaking law and stand in the line behind us.
