    EB2 India and EB2 China will have same cut off dates. I recall reading the USCIS explanation (in one of those AILA - USCIS conference) regarding distribution of unused EB2 ROW numbers and they mentioned that they have to keep EB2 I-C same till those catagories become current.

    Dear "colleagues in faith" :-), there is only one way to change the things with this immigration trap - we have to win the public opinion!

    Currently 350,000 highly qualified professionals working for this country are in a legal limbo which continues for years. Our current legal status is that of slaves. Yes, slaves! Nowadays it takes anywhere between 5 - 10 years from applying to receiving of a GC. We cannot change our employers within this period, the members of our families cannot work (at least legally) and our spouses lose their professional carrier; if our kids get in college they are treated as "aliens" (full tuition, no student loans, no scholarship); the loans we get are with higher interest rate (for "protection"); at the borders we are treated as "intruders" etc.

    The average Americans are honest hardworking people. If they are aware of the immigration problems faced by 350,000 hardworking professionals in this country, they will raise their voice and will help for resolving of this issue. They just need to know that. I believe that in addition to talking to senators etc., we have to find ways our issues to reach the media - newspapers, magazines and so on. An article in Times may lead to a lot of positive changes in the immigration system.

    I believe the 140 backlog is artificial. They processed only 2k cases in one month. How come they finished all EADs in 3 months for all June/July filers? There is something more to all this than meets the eye.

    Bootmline is they want to make it hard for us one way or the other. Btw, I had just come out of BEC and got stuck with 140 now.

    When did your labor process from BEC? Do you know if there are any pending cases with National processing center, which is the successor of BECs?

    So I am guessing that there's no significant change in policy towards EB-2 from what appears in the memo. They are merely reiterating on what exists. Lets not sweat.

    I have a suggestion we need to meet the senators office in person and also try to get more visibility in terms of getting exposed to media may be channels like

    a) AZN TV
    b) India waves
    c) CBS
    d) NBC

    Since we have hired Quinn & Gillispie we need to understand whats their strategic plan and what they have in plate for us. We need to have vision in front of us. All I am trying to say is identify the senators who would favor the CIR/SKILL Bill etc and have the immigrationvoice.org volunteers meet them in person. Some of the things I have mentioned may be redundant but, I wanted to make my point clear, calling the senators office just a week before with phone calls webfaxes etc is not just bearing any fruits as we have learnt from our past experiences.

    I would request the senior members of IV to have a one-one meeting with Quinn& Gillispie and later update all the members here.

    Can somebody explain me why this disco guy and this Villamonte guy are even on this forum ??? We are sitting here for 9-10 years telling our folks in our home countries, I'll come in may, no probably july, no in july my papers goes for renewals,, may be Dec. no in Dec. tickets are too expensive and in March I have my project live date, may be next may oh no by then I'll have to send my papers for renewal.... well you know what, forget about me, you stay happy where you are and I live happily here....

    And these people are telling us USCIS is doing what they should be doing...

    Because this is an open forum or it is called a forum and I'm a member like you.

    Mirage, we have our own frustrations with USCIS and I'm with you, but if you really think that you can get the information you wanted from USCIS, go ahead. Nobody is stopping you.

    Come on.

    I'v send a letter today. Let see if the Ombudsman will send me a answer.

    I received a answer after 2.5 months.
    The Ombudsman said, Proccesing times August 2, 2007, EB3 ROW, my I-140 is processing on time. My I-140 EB3 ROW was filed on August 22, 2007.

    Generally they give this update on last week of every month.

    I don't know why they updated us so fast with in a week on this.

    May be because they are not expecting to enter the July applications in the system (or just uptill July 2)

    My wife works in a company where a good number of IT folks are staffed by INFY. The poor quality of work made the company think about not extending INFY's contract. But then it came out in the open that there was no documentation on how the applications were built, etc. INFY got wind of this, and now they have positioned themselves in the organization where without them, this company's IT would collapse.

    There are many such stories of outsourcing firms that are holding client companies hostage. Though I do not agree with the bill, I think the bill brings back some ethics into play. Especially the L1 loophole.

    I squarely blame it on the company for not requiring INFY to document everything. There is such a thing as process or quality control. They have painted themselves into a corner. Having said that, companies will take advantage of this situation. Its just plain business...

    Did any of you get the same letter with the same content below .........what baffles me is the last sentence that says "The application will be reopened and the processing continued. Once the processing is completed, you will receive a notice under separate cover."

    Your help is really appreciated in this.........Sorry I am little bit pessimistic here......

    My I-485 case got reopened after being in denial status for three months............ My attorney got a letter from USCIS.

    I went to the Congressional office on 05/14/2009 morning.
    Congressional office made a call to Nebraska Service Center regarding the case on the same day afternoon (05/14/2009 afternoon)
    USCIS sent letter to my attorney on Friday (05/15/2009).
    My attorney received it this morning (05/19/2009).

    Looks like magic........Whoever has been working on my case from the past three months made a huge reversal decision in just a few hours on 05/14/2009 afternoon with atmost attention........I like this sudden surge in commitment and care on my case.......

    Here is the wording:

    Reference is made to the Notice of Appeal or Motion (Form I-290B) filed on April 23, 2009. You are seeking reopen the decision rendered by USCIS on February 17, 2009, denying application filed by you.

    My company HR received a letter from PBEC questioning the existence of our company. This is another step in the bureaucratic ladder of PBEC. First the 45-day letter to signal the intent to continue the petition, then proof of company. I wonder how PBEC thinks the LCA made it all the way to federal without anybody verifying the employer details. HR manager sent the company charter to PBEC to prove the company exists. So the wait goes on ...

    hi i have come to the u.s. on a f2 visa and currently my spouse is doing her OPT.i applied for a driving licence in georgia and i was issued a learners permit based on my I94,visa and letter from social security office denying me a ssn.
    i went to the same centre(decatur) for a road test and now they say that we cannot give you a licence because your visa says dependent for a student of wisconsin university,so you should go to wisconsin and get your licence.i went to another dmv centre and after verifying my docs. they let me take the road test and i cleared the test and they asked me to go to the counter to pay money , at that time the person in the counter again asked me for passpoert and i94 and he saw that university of wisconsin stuff on my visa and he said he will not issue a licence and i spoke to the supervisor and he says get a letter from INS ,i showed him my spouse opt card and showed him the words in the card which reads"eligible to work in u.s. upto ----").now he says that is your spouse opt card ,what autorisation do you have to stay in GA ?
    has any one come across such a problem?is so kindly advice

    You will be able to see your actual RD in the reciept notice...Donot worry..

    Can you please specify which numbe do we need to call & and what we need to enter (PD, I140, bla bla) to get the Receipt Date.......

    In 2002 all the EB visas were issued (174,968). However, there were 31,532 unused family preference visas, so the limit for 2003 was 171,532 (140,000 + 31,532).

    Guess what, in 2003 they only approved 82,137 EB visas, so they ended up with 88,482 unused EB visas

    From where did you get 174,968?
    Is there any case where unused FP #'s were captured for EB?
