Dear attorneys, I have a situation and will appreciate your response on it.
My PERM was recently approved and my company is getting ready to file the I-140. My attorney just noticed that my company at the time of registering the PERM account accidentally listed the FEIN number of their sister company (with similar name) rather than the FEIN number of the company that filed my PERM and on whose payroll I am for the last three years.
Do you think this would be a problem at the I-140 stage since the FEIN number on the PERM is different from the one on the Form I-140 and my paystubs/ W-2? My attorney is telling me that this should not be a problem as it is a typo and he can explain this to the US CIS at the time of filing the I-140 or maybe we can stay quite about it now and will explain it to the US CIS if they have any questions about it.

Now things are not predictable. I prefer premium process with an extra 1000 USD

My wife is currently applying for labor certification and I am planning to start my process for green card also. Is it advisable for both of us to apply for the green card? Is it considered duplication by the INS?
The reason for both of us starting the green card is that in case one of us has to move to a different job the other green card application might serve as a backup.
Please advise.

Currently on EAD expire on Feb 2011. I 140 approved. 485 filed and pending.

It is advisable to file change of status to h4 while in USA, no need to go back to india. After you get your h4 approved then you can go for stamping...

Hi,
My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
The Approved H1B documents along with new I-94 is with her employer.
We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
Do we still need her H1B and new I-94 documents from her employer for any reason?
Any advise is well appreciated.

Yes, it uses the same mount. Newer lenses usually have more data that is passed to the camera body such as distance, etc.. I'm not a Nikon person anymore, so double check of course!

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

Hello Attorneys,
My company recently moved offices to a new location just a few miles from the old location. Its in an adjacent county but with in the same state. We moved from Northbrook, IL to Deerfield IL, does this warrant a change in LCA/H1B?

Hello,
I have few questions and seeking your advise on it. Currently I have a H1B and EAD with EB3 category GC application.
1. I am working on H1B for "X" company and they have filed extension for it. Now, I got an offer from "Y" company and they are willing to transfer my H1B.
Is there any problem for H1B transfer to the Y company while it is filed for extension from my current employer?
2. The new company "Y" is also going to file my new GC labor and I-140 as job has little different and senior role but similar to what I had in my previous H1B and GC labor in EB2 category.
Now, can my current employer "X" company remove I-140 or create any kind of problem for my immigration status, specially with GC?
Any information, you can provide will be really helpful.

I need feedback from you guys. I have researched this lawyer before I got her to start my greencard and the feedbacks seems that she is efficient and knowledgeable. However, since we signed the contract with her, things have been moving so slow. She doesn't want to talk to me or give me status updates when asked. She has all the information needed from me and my employer to start the prevailing wage request but a month has passes and nothing has been requested yet. Has anybody here experience the same thing?

I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.
I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

If it is a non profit research org or institute of higher education then H1 will not be counted towards quota. On the other hand if you have the credentials you can try for "O" VISA

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

Hi I just graduated last year as an accounting major. I recently got an offer for a Property Accountant position at a real estate company. So it's not a pulic accounting firm. I was wondering if I'm eligiable to apply for H1B without a CPA?
