If your old visa has not beenexpired at the time of re-entering . You will need to carry your new approved I-797. But your I-94 would have the expiration date as that of the expiration date as on your old Visa.
I had the same situation last year and the processing went smoothly at port of entry, but you may check for any chages in the regulations.

a) H1 extension(I797) approved but no I94
b) Visa stamp and I-94 expired when I applied ( my mistake)for extension but I-797 was valid. Have EAD and Advance Paroll
c) Wife is on H4 and I cannot add her to greencard process because priority date is not current.
d) I need to maintain H1 for my wife.
e) She returned to India before her H4 expired.
f) I work at a client location via a middle vendor so recently found out it does not conform to H1 employer-employee relationship.
1) Is there any time restriction on when I should get Visa stamping done?
2) Client agreed to give client letter but I am worried that I will be rejected at H1 visa stamping because of employer employee relationship requirement.
3) Is it a better startegy to not go to India, send my wife for H4 stamping and bring her to US or is it safer for me to go for H1 visa stamping?
4) Should I change jobs to a client who will transfer H1 and continue my greencard (possibly apply for EB2) before going to India for H1 stamping?
5) Please suggest best course of action.

I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. Thanks as always...

I filed green card with my old emp. in 2002, i applied for i485 July/07 and in APR/08 i change my job to similar profession, now i work and live in MD, and my interview for status adj is sch in NJ, should i notify and change address to MD since i live , work and my current emp. in MD. I applied for a green card via a relative application on April 28th of 2001. I am under the 245I law. It has been 10 years since the application and it has been approved. A lawyer told me I have one more year to wait since they are still working on the visas from April of 2001. My question is: What month are they on currently and is there any way I can speed up this process? Is there a website where I can keep track of where the visas are?

I first off apologize if there is already a thread pertaining to my questions. If so I would greatly appreciate being directed.
My situation is this...I came to the US as a visitor from Canada. As a result I did not need a I-94, a visa or a passport since i travelled by car. I am going to be married to a US citizen in a couple of weeks. I guess my questions are these...#1. Since I did not need any of those documents to enter the US, will this cause a problem while trying to prove status?
#2. I read somewhere about filing a I-30 prior to other documentation such as the I-485 and medical and so on. I was wondering if this is true or if i even need to file this document or if so if it can be filed in conjunction with the others.

Can I apply for AP renewal now even if my current AP expires in mid Oct 2009 or should I wait until the expiration date is 90 or 120 days (like H1 renewal).
My EAD expired last year and I have not renewed it, so I should be good on that (I am working on H1) but had a question on AP.

Hi,
I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

I am a software engineer who just received the EAD. Does this mean I can now start working as a Barista at Starbucks? What does an EAD really give me?
